Welcome to Health Attai! This document outlines the terms and conditions governing your use of the Health-Attai platform. 

This platform, www.healthattai.com/, is owned and operated by Destratum Solutions Private Limited. Health-Attai provides a comprehensive healthcare management platform that includes information, tools, and services designed for your use.

This Agreement is made between you and Destratum Solutions Private Limited. Your access and usage of this platform are subject to your acceptance of all the terms, conditions, policies, and notices detailed herein. By accessing any part of the platform or utilising its services, you signify your agreement to comply with this Agreement, our Privacy Policy, and other applicable rules, guidelines, policies, terms, and conditions related to the services and modules provided through Health-Attai. These collectively form the 'Terms'.

If you do not consent to all the terms and conditions set forth in this agreement, you should refrain from accessing the platform or using any of its services. Your use of our healthcare software services signifies your acknowledgement that you have read, understood, and agree to these Terms and Conditions.


Nature of Services and Disclaimers


  • Informational and Scheduling Purposes Only: The information you obtain or receive from Health Attai, its employees, contractors, partners, sponsors, advertisers, or otherwise on the Site is for informational and scheduling purposes only. Our healthcare software is designed to enhance medical operations and communication.
  • Not Medical Advice: The information provided on the site is not intended as a substitute for, nor does it replace, professional medical advice, diagnosis, or treatment. You should not disregard, avoid, or delay obtaining medical advice from a qualified healthcare professional because of something you may have read on the site. Do not use the site for emergency medical needs. If you experience a medical emergency, you should call a doctor directly. 
  • No Endorsement or Guarantees: We do not recommend or endorse any specific tests, physicians, procedures, opinions, or other information that may appear on the Site. If you rely on any information provided by the Site, you do so solely at your own risk. We make no claims as to the effectiveness of any procedures, products, services, and devices discussed or advertised within the Site.

User Accounts and Responsibilities


  • Registration and Credentials: As part of the registration process, you will provide an email address, mobile number, and create a password. These are your credentials for accessing the Services. You should keep your Credentials private and not share them with anyone else. You are responsible for notifying us if your password has been hacked or stolen.
  • Account Confidentiality: You are responsible for maintaining the confidentiality of your account credentials and any actions taken under your account. You agree to provide accurate and up-to-date information.
  • Data Input and Accuracy: You are solely responsible for the data you input into our healthcare software. You warrant that you have the necessary rights and permissions to input and manage such data. You understand that we provide the software tools, but you are responsible for verifying the accuracy and integrity of the data.
  • Lawful and Non-Commercial Use: You may use the Site and the Services for lawful, non-commercial purposes only. You agree to use our software for legitimate healthcare-related purposes only.
  • Prohibited Activities: You agree not to engage in any activities that compromise the security, privacy, or functionality of the software. Without limiting any of the foregoing, you agree that you shall not (and you agree not to allow any third party to):
    • Copy, modify, adapt, translate, or reverse engineer any portion of the Site, its content or materials and/or the Services.
    • Remove any copyright, trademark, or other proprietary rights notices contained in or on the Site and/or the Services.
    • Use any robot, spider, site search/retrieval application, or other automated device, process, or means to access, retrieve, or index any portion of the Site and/or the Services.
    • Access, retrieve, or index any portion of the Site and/or the Services for purposes of constructing or populating a searchable database of reviews related to the healthcare industry or medical physicians.
    • Reformat or frame any portion of the web pages that are part of the Site and/or the Services.
    • Fraudulently misuse the Services by scheduling an appointment with a physician which you have no intention of keeping.
    • Create user accounts by automated means or under false or fraudulent pretences.
    • Collect or store personal data about other users in connection with the prohibited activities.
    • Use contact information provided by our users or collaborating physicians, or harvest such information for the purpose of sending, or to facilitate the sending, of unsolicited bulk communications such as SPAM. You may not allow others to use your account to violate these terms.
    • Transfer or otherwise make available to any third party the Services.
    • Provide any service based on the Services without prior written permission.
    • Use the third party links to sites without agreeing to their website terms & conditions.
    • Post links to third-party sites or use their logo, company name, etc., without their prior written permission.
    • Use the Services for spamming and other illegal purposes.

Content Ownership and Posted Information


  • User-Posted Information: You will have the opportunity to submit feedback regarding your experiences with doctors, submit inquiries, and participate in interactive features ("Posted Information"). You’re responsible for any content you submit, such as feedback or inquiries. Avoid offensive language, personal attacks, or anything unlawful or infringing. Do not post copyrighted, misleading, or harassing content, and refrain from spamming. Health Attai may review, publish, or remove your content at its discretion and is not liable for delays in doing so. 
  • Health Attai Content: Except for user-submitted Posted Content, all information available on or through the Services and/or the Site (text, photographs, graphics, video, and audio) is owned by us and our licensors and is protected by intellectual property laws. You may print, download, and store information from the Site for your own convenience, but you may not copy, distribute, republish, sell, or exploit any of the content, or exploit the Site in whole or in part, for any commercial gain or purpose whatsoever.

Data Privacy and Security (ABDM Compliance)


Integration with ABDM: We are ABDM-compliant and integrate with India’s Ayushman Bharat Digital Mission (ABDM). By registering on our platform, users consent to the sharing of relevant health data with the ABDM ecosystem, including the generation and use of ABHA (Ayushman Bharat Health Account) IDs.

User Rights Under ABDM:  In accordance with ABDM policies, users have the right to:


  • Access and view their personal health records.
  • Request corrections or updates to any inaccurate health information.
  • Delete or revoke consent for data sharing at any time through the ABDM portal or linked health apps.

International Data Compliance: If you are accessing our platform from regions outside India (e.g., the European Union), we are committed to aligning with applicable data protection regulations such as the General Data Protection Regulation (GDPR). This includes lawful processing, user consent, the right to data portability, and the right to be forgotten.


Changes to Terms and Services


We may update these Terms at any time. Significant changes will be notified via email or within the software. By continuing to use Health Attai after changes take effect, you accept the updated Terms. If you disagree, please stop using the software. We may add, change, or discontinue services at any time without liability.


Termination


We may suspend or terminate your account without notice for violations or prolonged inactivity. Health Attai is not liable for any resulting loss. After termination, you must stop using the platform.


Eligibility and Geographical Scope


  • Age Restriction: You must be 18 years or over, or the legal age to form a binding contract in your jurisdiction if that age is greater than 18, to register with us or use the Site and the Services. If you are under the age of 13, you may not use the Site or Services. If you are the parent or legal guardian of a child under the age of 18, you may use the Site or Services on their behalf, representing and warranting that you are their parent or legal guardian.
  • Geographical Scope: The Site is administered in India and intended for Indian users. Any use outside of India is at the user's own risk, and users are responsible for compliance with any local laws applicable to their use of the Services or the Site.

Electronic Contracting and Notices


Your affirmative act of using this Site and registering for the Site or the Services constitutes your electronic signature to these Terms of Use and your consent to enter into agreements with us electronically.


Dispute Resolution and Jurisdiction


Governing Law and Jurisdiction: These Terms shall be governed by the laws of India. In case of any dispute, the courts of Chennai, India shall have exclusive jurisdiction.

Arbitration Clause: Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Chennai, and the proceedings shall be conducted in English.


Indemnification Clause


You agree to indemnify and hold harmless Health Attai, its affiliates, directors, employees, and agents from any claims, losses, liabilities, damages, and expenses (including legal fees) arising out of or related to:


  • Your use or misuse of the platform.
  • Your violation of these Terms.
  • Your infringement of any intellectual property or privacy rights.

Intellectual Property 


License to User Content: By submitting content, feedback, or suggestions, users grant Health Attai a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, adapt, publish, or distribute such content for purposes including platform improvement and marketing.

Takedown Process for Infringing Content: We respect intellectual property rights. If you believe your copyrighted content has been infringed on our platform, please contact us at contact@destratum.com with relevant documentation. We will review and, if appropriate, remove the infringing content in accordance with applicable laws.
